Of course, in some circumstances a Divorce or Family dispute may require both parties to retain a lawyer and go to court for trial. It may be that the parties simply cannot find any common ground or that the case has some complex element to it that requires a judge to issue a ruling. What is "Collaborative Divorce"?
Mediation requires that the divorcing couple be able to sit together, with an impartial mediator, and come to agreement on the issues that need resolution before their divorce can take place. Therefore, mediation may not be right for everyone. Another "low-conflict" option to Divorce Litigation is "Collaborative Divorce," in which each party hires a collaborative lawyer, who will agree in writing that taking the case to court to resolve any of the disputed issues is not an option.
Once the option of going to court is removed as an element from the negotations, the parties and their lawyers are able to strive to reach agreements on the issues, making the negotiations less contentious. If the negotations fail, each party will need to hire another lawyer to take the case to court -- which is another finanical incentive for them to work out their differences in negotations.
